Five of the more-than-ten MAJOR MISTAKES Family Court judges make, routinely and perpetually.

How to correct them with unassailable data, facts, logic and - YES - law. These mistakes have cost divorcing American homeowners untold $millions in their estates, wreaking havoc upon the children of divorce, needlessly displaced from their familiary surroundings. The solutions are so simple and save the court (including mediations) countless hours typically wasted debating over factors that are already settled by the law and the market. Be prepared to be shocked!

Divorcing the House: To Sell Or Not To Sell

Lawyers are asked by their clients if they can "get" or "keep" the house; at the same time, lawyers, mediators, judges - not to mention, the parties - ask if one or the other can "afford" the house. Often, the knee-jerk reaction is to sell the house. But, this kicks the can to the other side of the road and not much further down it. This course shows the attorney exactly what questions are relevant to an answer; and most importantly, how to discover the precise answers. Many times, restructuring debt through mortgage financing is one solution that helps parties get to an answer. Other strategies are presented that allow the attorney to provide their clients with everything they need to answer the question - to sell or not to sell.

  • What CAN be done? Find out first. (Mortgage qualifying)
  • Can one or both parties “afford?”
  • Can one or both parties “qualify?”
  • When it switches from a sale to a 3rd party to awarding house to one of the parties, what legal steps are involved? Does it matter?
    • The foibles of pretending it’s a sale when it’s actually a refinance.
  • Receivership
    • Can receiver fees be included in a refi? Yes. Here’s how…

Credit and Income Qualifying Your Divorce Clients

Shows how strategic planning can qualify divorcing clients more quickly than previously thought possible. The course shows lawyers how to help their clients literally create "qualifying income" for mortgages out of thin air. These practical strategies are widely needed, and built around universally required mortgage guidelines. Credit qualifying utlizes programmed algorithms to determine when a credit-challenged borrower will qualify for a mortgage and exactly how to "get there." This proves powerfully useful in negotiations that, otherwise, waste a lot of time questioning whether or not the proposed borrower can or can't qualify for financing. One more strategy in the series that cuts down on time spent figuring out what the instructors have already figured out. Advanced Credit and Income Qualifying for Divorcing Homeowners.

Watch Your Language: Mediation Magic for Mortgages

This presentation gives lawyers and mediators a template for preparing their clients for the home mortgage issue in upcoming mediation. It aims to dramatically reduce wasted time with fruitless discussion about this issue, by obtaining for the proposed home owners (borrower) the precise terms of loan approval that fit within the parameters of the proposed settlement. Generic loan approvals are useless in this setting. Only a synchronization of FINAL divorce terms with a client's mortgage loan will work. But, how does mediation achieve that PRIOR to final divorce. This course shows how to do it with surprising ease. Solutions that anticipate final divorce and provide a road map to finalize with amazing success. 5 Magic Phrases to include in MSAs will work mortgage miracles for the settlement.
